1. Introduction
These Terms and Conditions apply to all sales of goods by Hosplant Ltd (“we”, “us”, “our”) whether purchased via our website, by telephone, email, in person, or via trade account.
By placing an order, you agree to be bound by these Terms.

3. Customer Types
We supply goods to:
- Consumers (private individuals)
- Business customers / Trade customers
- Approved credit account holders
Different rights apply depending on customer type.
PART A – CONSUMER SALES (B2C)
4. Consumer Cancellation Rights
Under the Consumer Contracts Regulations 2013:
- You have 14 days from delivery to cancel your order.
- Goods must be unused and in original condition.
- Return costs are the customer’s responsibility unless goods are faulty.
Refunds will be processed within 14 days of receiving returned goods.
5. Faulty Goods (Consumers)
Under the Consumer Rights Act 2015:
- Goods must be as described, of satisfactory quality, and fit for purpose.
- You must notify us within a reasonable time if goods are faulty.
- We may repair, replace or refund as appropriate.
PART B – BUSINESS / TRADE SALES (B2B)
6. No Consumer Rights Apply
Where goods are purchased in the course of business:
- The Consumer Contracts Regulations do not apply.
- Returns are accepted only at our discretion.
- Goods must be inspected upon delivery.
Any claim for shortage or damage must be made within 48 hours.
7. Limitation of Liability (Business Customers)
Subject to law:
- We shall not be liable for indirect or consequential loss.
- Our total liability shall not exceed the invoice value of the goods supplied.
- We do not accept liability for business interruption or loss of profit.
PART C – CREDIT ACCOUNTS
This section is very important legally.
8. Credit Account Terms
Credit accounts are granted at our discretion and may be withdrawn at any time.
By opening a credit account, you agree:
- Payment terms are strictly 30 days from invoice date (or specify your term).
- Time for payment is of the essence.
- We may carry out credit checks.
9. Late Payment
If payment is not received by the due date:
- We reserve the right to suspend further deliveries.
- Interest will be charged under the Late Payment of Commercial Debts (Interest) Act 1998.
- Interest will accrue at 8% above Bank of England base rate.
- A fixed debt recovery charge will apply:
- £40 for debts up to £999.99
- £70 for debts £1,000 – £9,999.99
- £100 for debts over £10,000
We also reserve the right to recover reasonable recovery costs.
10. Retention of Title
All goods remain the property of Hosplant Ltd until paid for in full.
Until ownership passes:
- You must store goods separately.
- We may recover goods if payment is not made.
- Risk passes on delivery.
PART D – GENERAL TERMS
11. Pricing
- Prices are in GBP.
- VAT is charged where applicable.
- We reserve the right to amend prices.
12. Delivery
Delivery times are estimates only.
We are not liable for delays outside our reasonable control.
Risk passes upon delivery.
13. Product Use & Responsibility
The buyer is responsible for ensuring goods are suitable for their intended purpose.
We accept no liability for misuse, incorrect installation, or improper operation.
14. Website Use
All website content is owned by Hosplant Ltd and may not be copied without permission.
15. Force Majeure
We shall not be liable for delays caused by events beyond our control including:
- Supplier delays
- Transport disruption
- Industrial disputes
- Government restrictions
16. Governing Law
These Terms are governed by the laws of England and Wales.
Disputes shall be subject to the exclusive jurisdiction of the English courts.
